HOMESUPPORTER SERVICE- HomeSupporter T&C’s
Unity Living Ltd sub-brand Helpful HomeSupporter will only undertake business on the following Terms and Conditions. These terms are legally binding so please read them carefully.
Please note:
- The people we introduce are the ‘HomeSupporter‘
- Helpful HomeSupport is referred to in this document as the ‘Agency‘
- The person requesting the help in their home is referred to as the ‘Client‘
- Helpful HomeSupport is an introductory agency introducing self-employed personnel ‘HomeSupporters’ to ‘Clients’ who engage them directly for a period of time. By submitting an Application Form you are accepting our Terms and Conditions.
- Once a HomeSupporter has completed the Agency’s vetting procedure and a profile of them has been completed, they will be introduced to clients as and when. It is the responsibility of the HomeSupporter to keep the Agency informed of any interviews attended with Clients.
- The Agency should be notified immediately a HomeSupporter is offered, and accepts, a job. A clear Enhanced DBS for Adults is a requirement for a HomeSupporter. The Agency can apply for one of these on behalf of the HomeSupporter. The HomeSupporter is responsible for paying for this and then keeping it up to date by Registering with the DBS Update Service.
- Clients are responsible for direct payments to HomeSupporter’s engaged as a result of introduction by the Agency. It is the HomeSupporter’s responsibility to ensure they are paid and to agree with the Client how payments will be made ie; daily, weekly or monthly in arrears, usually depending on the daily length and frequency of visits.
- The Agency charges an Agency fee of 10% + VAT on top of the HomeSupporter’s hourly rate. HomeSupporter rates are set by the Agency and are advertised on the website.
- Any Client re-booking a HomeSupporter after a break [not including short term breaks such as holidays or sickness] must contact the Agency as it will be treated as a new introduction and a HomeSupporter must notify the Agency if a Client does so.
- The Agency assumes that all details of the Engagement have been agreed between the HomeSupporter and the Client unless the Client or the HomeSupporter informs the Agency in writing to the contrary prior to the commencement of the Engagement.
- The Agency acts as an introduction Agency only and does not directly or indirectly employ the HomeSupporter who is self-employed.
- Whilst the Agency interviews all potential HomeSupporters and tries to ensure full reference checks are carried out, the Client has the right to make their own enquiries and checks and to satisfy themselves as to the suitability of the HomeSupporter.
- It is a condition of after introduction working through the Agency that the HomeSupporter has Professional Liability insurance for the role and must provide a copy of this on request.
- The Agency reserves the right to use its own discretion with regard to any situation or problem not itemised in its terms.
- A HomeSupporter’s hourly rate is set by the Agency as per the advertised rate. If the HomeSupporter hourly rate, or the Agency fees, need to be increased, the Agency will give the Client two months’ written notice.
- If a HomeSupporter introduced by the Agency is subsequently booked in any other capacity, then an additional fee will be required.
- It is a condition of introduction to a Client that the HomeSupporter provides a copy of all their invoices to the Agency. Failure to do this will result in a HomeSupporter being stuck off the Agency database and the Client notified. The Client will be charged a recruitment fee if they subsequently continue to use the HomeSupporter independently of the Agency.
- All information is confidential and must not be passed to a third party, either directly or indirectly. If information is passed to a third party, and a HomeSupporter is booked/engaged otherwise than through our Agency, this will constitute a breach of our terms, and the appropriate fee will be charged to the Client.
- If the HomeSupporter has a car and a UK driving licence and is prepared to use their vehicle it to run errands or take the Client on a journey, the HomeSupporter must show the Client that they have valid business use car insurance. The HomeSupporter can claim motoring costs from the Client at the rate of 45p per mile, plus parking on any journey with or on behalf of the Client. If the HomeSupporter agrees to drive the Clients car they must ensure the Clients motor insurance covers them to do so.
- HomeSupporters must maintain now, and at all times in the future, the strictest confidence concerning the Client and their family, and the Agency’s business.
- To operate Unity Living sub-brand Helpful HomeSupport service we need to collect and hold some information about you. Information being held about you will be used in accordance with the Agency’s Privacy Notice. By agreeing to our Terms and Conditions you are also accepting that some personal information about you will be shown to the prospective householder and their representative.
